The Sustainability of Certain form Requirements for E-commerce
This paper argues that the retention of certain form requirements under the existing law in Malaysia is not fully sustainable for the promotion for e-commerce. Some requirements could impede contracts from being performed online, and the rest may not be desirable and less receptive for the development of electronic commerce activities through the internet. This paper identifies the undesirable requirements and makes the necessary recommendation for the reform of the law towards a more conducive environment for e-commerce.
